Im trying to figure out if i have the right to know if my ex(custodial parent) smokes cigaretts. She never has before but i saw a pack when i dropped my daughter off a few days ago sitting on her table in her apt.(in plain sight from the front door so i wasent snooping or something), and when i asked if they were hers or just someone she had over's she told me it was none of my bisness(sp). do i have the right to know if she started smoking?

I've seen/heard that some orders stipulate that both homes will be smoke free.  If your order has this listed, by all means you have the right to ask and get a straight answer.

Otherwise I really don't know from a legal point of view.

Smoking is one of those topics that the court rarely brings up unless there is an existing reason for concern for the children, i.e. asthma.  It is unfortunate that children have to be subjected to second hand smoke, since it is not their choice to be around it, but I think you should be aware if there is smoking going on in the ex's home, since it may be useful ammunition to gain a change of custody or a substantial increase in visitation, especially if you can show that their actions have caused harm to your child.
