My stepson is 20 and dropped out of college for 1 semester.(Jan-June)during that time he was living at home (with his mom) and working fulltime. we did not pay any child support for him during this time. Now he is planning to return to community college this fall full-time and continue to work-Do we have to resume child support or does it stop completely as he was not in school at all this year?? We live on long island in NY.Thanks for your help

This is a good one.. It varies by state but once a child becomes less than a full time student they have lost their eligibility to receive all forms of support.  Thankfully I live in a state where a supreme court has ruled that college support is unjust.  I have a huge issue with this topic.  If a NCP can be forced to pay support for college than why can't a married couple be forced also??  If not could I later sue my parents to pay off college loans etc.. etc.. It just opens a whole slew of BS.  I think paying support during college is the biggest injustice to the system I have ever seen..

I live on LI as well, and per my husband's divorce decree, he is ordered to split college costs with his ex.  Easy for her since she's getting about $1300/month in support.  What gets me is first...how can someone be court ordered to pay for college?  Second...we have a daughter together, and what REALLY pisses me off, is that in the eyes of the court, HER college education (or whether she lives or dies for that matter) doesn't matter.  She can fend for herself.  However...if my husband and I were to get divorced, then all of a sudden, she would matter!!  As a matter of fact, in the eyes of the court, right now she doesn't matter at ALL!!  My husband had no business having her because he's already got two other kids to support and of course they come first!!!  Actually, I should rephrase that.  Their MOTHER comes first.

All I can say is this.  When the times comes, if we don't have the money (which after $1300/month in extortion money, I highly doubt we will), then we won't pay.  Can't get blood from a stone, right?  Try to make us pay...I dare you.  My husband has relatives in another country and we'll be more than happy to move there.  Screw you NYS Child Support (Extortion)!!!
