I just recently found out that my exgirlfriend is moving and I don't think she will tell me about it. Since we have never been to court for anything, and I have never had missed a payment, does she have the right to up and move without telling me where my daughter is?

Also, DHS has been garnishing my wages in the month of June for what reason I don't know cause I have never missed a payment. She texts me yesterday asking me if I have sent my child support. I told her that DHS has been garnishing my wages all this month and that she needed to call DHS to see what is going on.  Can anyone tell me why she hasn't received her June child support?

Hopefully others will be able to help you out with all of this, but i wanted to touch on the garnishment...based on how I've seen payroll go before...

When I used to do payroll, the one company i worked for would take the ordered weekly amount from the employees check, however only one check per month per employee was sent to the various CS office(s).  This is the way this particular company always worked it, but after being there awhile I asked if they could be sent every week or at the very least every 2 weeks.  This is because I was tired of getting the calls from angry ex's looking for their money and rude CS people trying to tell me that we had no right NOT to send the checks on a weekly basis.  The company followed the order but CS agencies hate paperchecks that must be PROCESSED by them because it causes them to have to actually work.

From the orders I've dealt with, CS does not HAVE to be sent on a weekly basis, some states actually had provisions for quarterly payments.  The orders usually have a listing of the garnishment amounts based on how the employer is going to submit the payment...

for instance, if submitted weekly, a monthly CS amount of $100.00 would be broken down to about $23.00 sent per week.  Every two weeks was about $46.00 and monthly would be $100.00...but as long as it was paid on time, it was the employers choice to submit it however they wanted (within the parameters of the order).

This being said, this company also did not utilize a payroll company, nor did they have direct deposit.   All CS payments were sent via first class mail to the appropriate agencies...which resulted in a multitude of calls on the last day of any given month or first day of the next month.  Irrate exes looking for their money and agencies trying to crack down.

So depending on how your company handles payroll, they may have sent your CS payment via first class mail on June 27, 2008 (or on the date of your last paycheck for the month) and it may not have been PROCESSED yet by the CS agency.  You NEED to be careful of this...even if it is the companies &&*%ty practices causing the payment to be late...it will be your fault. 

Another company I worked for utilized a payroll company.  So paychecks as well as any and all garnishments were direct deposit situations.   Garnishments were taken AND submitted on a weekly basis and it was a dream.  With the exception of an occassional glitch somewhere there was never a complaint from ex or agency.

Gosh this stuff gets so confusing. But thank you for your replies. Can anyone answer my first question about my ex girlfriend moving without telling me? Can she do that?
