Childless man freed after serving time for child support violations – CNN.com
(CNN) — Frank Hatley spent the past year in jail for being a deadbeat dad. But there’s one problem — Hatley doesn’t have any children. And the “deadbeat” label doesn’t fit the 50-year-old either, his supporters say.
Frank Hatley had been ordered to make back payments even after he learned a teenager wasn’t his son.
After a hearing, Hatley was released from the Cook County Jail in south Georgia Wednesday afternoon, with the help of the Southern Center for Human Rights.
Superior Court Judge Dane Perkins ruled that Hatley was indigent and should not be jailed for not being able to make child support payments. Perkins postponed a decision on whether Hatley should have to make any more back payments on child-support for a child who is not his.
In June of last year, a judge ordered Hatley to jail for failing to reimburse the state for public assistance that was paid to support his “son,” who, as the court was aware, is not actually his son.
Hatley’s attorney Sarah Geraghty, who filed a motion for his release, called it a case of “blatant unfairness.”

Isn’t it amazing how we consider ourselves a civilized society, and yet this kind of thing can happen? How is it possible for an unemployed man, who is still actually paying something, to go to jail for falling behind. The judge that found this man in contempt and who sentenced him should be dealt with in a way that sends a message.

After reading this story it makes me wonder…As long as the state recoups it’s money do they even care who is hurt in the process..This man became HOMELESS!! and was still making payments…After such an ordeal some people would just simply give up.
I have been going down the same road as this story. Due to the economy Ive paid my ex over 50k in three years and I informed them due to outsourcing that I can’t pay my child support. So I missed 3 payments and now Im a felon and now really have chance of getting a job. My security clearence has disappeared. Plus Im paying for a child that isnt mine. So I wrote a book to help fathers and stepmom go thru the process and not do stupid mistakes I have along the way.

My book is a true life account story of my divorce experience and of what I had to go through, which includes child support and visitation battles. By writing this book I hope that through my honest (often funny) insights, it will help other fathers understand what they may encounter, during and after a divorce or the end of a relationship involving children.
This book includes my mistakes, successes and check lists to help fathers and stepmoms that become knee deep in the dysfunctionality of the court system. The court system and child services insist that what they care about is simply the welfare of the children yet the system ends up creating parental alienation in the process.
Fathers are torn away from their children causing a feeling of loss and desolation, not knowing what to expect next. Frustration gets the better of them, which is where extra mistakes begin to happen. They fall into a state of denial.
My book will help guide them with my helpful hints and mistakes as they go through the journey and understanding that when there are children involved, divorce doesn’t really mean it’s the end, but will certainly help them achieve a little leverage in the process.
My tips may help them anticipate situations that may occur and hopefully, help them be as prepared as possible for what they may face.
